Via the contact form we process your name, email address, organisation, subject and message, exclusively to answer your question and, if desired, to schedule a Discover call. With IMS services, session and usage data may be processed (based on consent and processor agreements) to make impact measurable; this is done privacy by design and is specifically agreed with you for each programme. We do not place tracking or advertising cookies and never sell your data to third parties.
Processing is based on your consent or legitimate interest (answering your request, performing the agreed service). We retain contact requests for a maximum of 24 months, unless there is an ongoing relationship. We retain client data in accordance with statutory retention obligations for administration.
You also have the right to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
We only share data with parties necessary for our services (such as hosting and email), on the basis of processor agreements (Art. 28 GDPR) including agreed security measures and data breach notification obligations. Our infrastructure runs on European, GDPR-compliant cloud (Infomaniak, Switzerland).
For applications involving AI we apply the precautionary principle: transparency about AI use, human oversight of AI-supported output, and no AI systems in risky categories without a prior impact assessment. In accordance with the EU AI Regulation (to be verified by a lawyer for your specific application).
Draft version: the final version will be established after review by an ICT lawyer and optionally registered with the Dutch Chamber of Commerce (KVK). Our assignments are primarily B2B.
These terms apply to all offers, agreements and deliveries by 4DWARE regarding advice, guidance and managed services in the field of immersive technology (XR) and AI, under Dutch law (DCC 6:218 et seq.). Where consumers (B2C) are involved, additional protective rules apply; limiting clauses are then not or only partially valid.
Offers are non-binding and valid for 30 days, unless stated otherwise. Agreements are concluded by written (digital suffices) order confirmation including scope, deliverables, lead time and remuneration.
Where execution takes place via qualified partner organisations, 4DWARE coordinates the value chain and is the point of contact for the coherence between technology, methodology and organisation. Third-party involvement is subject to partner organisations selected by 4DWARE and qualified for the task.
The client provides in good time the information, access and cooperation reasonably necessary for the execution. Delay caused by lack of cooperation may result in lead times and costs being revised.
4DWARE's liability is limited to the agreed order value, or to the amount paid out under the professional liability insurance, in accordance with the nature of the services and applicable law. Exclusion of liability for intent and gross negligence is not possible.
Documents, designs and methodologies created by 4DWARE remain the property of 4DWARE, unless expressly agreed otherwise. The client receives a right of use in accordance with the agreement. Published course materials may be shared under CC BY-SA 4.0 if attributed.
Both parties take appropriate technical and organisational measures in accordance with the GDPR. When personal data is processed on behalf of the client, the parties conclude a processor agreement (Art. 28 GDPR). In the healthcare context, NEN 7510 is also taken into account.
Either party may terminate the agreement in writing in accordance with the notice periods in the agreement. In case of force majeure, obligations are suspended; in case of permanent force majeure, the parties may terminate the agreement without liability for damages.
You can direct complaints to contact@4dware.eu; we respond within five working days and jointly seek a solution in accordance with reasonableness and fairness. Dutch law applies to the agreements.
